Apple Lets Fortnite Back In The App Store

After 5 years of banishment, Fortnite is back in the US App Store.  Has Apple turned over a new leaf and is now playing nice? Probably not.

In case you have missed the details of the ongoing saga - here is a simple, perhaps over-simple, summary:

  1. Apple's app store charges 30% and doesn't allow in-app purchases unless it handles the transaction and charges 30%
  2. Epic's boss, Tim Sweeney, notices this and decides to offer an alternative payment method for the hit game Fortnite..
  3. Apple removes Fortnite from the App store for breaking the rules.
  4. Sweeny sues Apple and Google. He loses the main case, but wins the right to operate external payment methods for in-app purchases.
  5. Apple agrees to the deal, but manages to implement it to its advantage with big warning signs that external payment sites are unsafe and that they charge for the privilege.
  6. Sweeney brings to light the issue of Apple not implementing the ruling in a proper manner and the judge agrees, ordering Apple to do the right thing.
  7. Now Sweeney and others are free to implement external payment sites, so avoiding the Apple tax, but Apple still manages to put red warning signs on the links.

After all this, Epic re-submits Fortnite to the App Store because now it is doing nothing wrong and conforms to Apple's terms and conditions, but Apple drags its feet. This seems to be a clear rejection of Sweeney's offer of a truce:

"Epic puts forth a peace proposal: If Apple extends the court's friction-free, Apple-tax-free framework worldwide, we'll return Fortnite to the App Store worldwide and drop current and future litigation on the topic."

Given Sweeney's persistence, this has cost both companies millions in lost sales,  Apple may come to regret this choice. To see if the problem can be solved, Epic makes a motion to the court to enforce the injunction and the ruling is:

That seems perfectly clear - lo and behold, Fortnite is back in the App Store. Apple and Epic issued a statement to the effect that everything was fine. Apple can't be happy that Epic has worked out a promotion where you get 20% back to spend in the Epic Games store.

This really does seem to be the end of days for Apple's App Store, but the show isn't over until the appeals judge sings. Apple is still appealing the decision, so watch this space.

Apple's latest attempt to maintain full financial control over the App Store has failed, allowing Fortite to stay in the App Store and Epic to use external methods for in-app purchases.
